Digital Millennium Copyright Act Notice & Takedown Procedure

OurSociete respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform.

Filing a DMCA Takedown Notice

If you believe that content on OurSociete infringes your copyright, you may submit a written notification to our designated DMCA Agent. Your notice must include the following:

  1. Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the content).
  3. Your contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature (typing your full legal name is sufficient for electronic signatures).

Processing of Takedown Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly
  • Notify the content creator that the material has been removed
  • Provide the creator with a copy of the takedown notice
  • Inform the creator of their right to file a counter-notification

Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification with our DMCA Agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notification.

Restoration of Content

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we will restore the removed content.

Repeat Infringers

OurSociete maintains a policy of terminating accounts of users who are repeat copyright infringers. We may, in appropriate circumstances, disable and/or terminate the accounts of users who repeatedly infringe the copyrights of others.

Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
